Criminal law

Crime is an illegal act, which can be punished by law concerning crimes and their punishments. The same act in different countries can be defined as a criminal activity, otherwise- legal manner.
There are two main elements to a crime: Actus Reus (guilty act; objective criminal state, causing the death) and Mens Rea (guilty mind; subjective criminal state, intending to commit a crime- malice aforethought). The most important is to prove that the act was a substantial cause of the result. Each person has a right to presumption of innocence and defense as duress, insanity, intoxication, self-defense and mitigation of punishment in accordance with a crime of passion.
Governments have huge power in decriminalizing crimes and making new ideas legal or illegal behaviour.

Never again

Positive and negative aspects of capital punishment are as contrast among humanity and law enforcement.
First side approve execution supporting with detterrence theory, which tend to stimulate deliberate decision before criminal acting, then ensuring public security eliminating opportunity to kill again releasing murderers after 20 years imprisonment, retribution as a revenge effectiveness owerawing potential criminals and decreasing outgoings for prisoners' needs to survive. Second side argue that death penalty due to Britain 1903-1904 year statistics was pointless, because of increased homicides. If culprit is innocent, adjudgment violate his right to justice and fairness. Also, religion propagate forgiveness and the last is state's role in society solving problems without violance to its citizens.
To sum up, history shows that death penalty implement order, on the other hand it can cause humanity degradation.

My future profession

In 2007 as I entered second level of my life- entered university of Mykolas Romeris, due to my studies I faced new social problems. Now my life purpose is not only finish bachelor (not talking about master's degree) studies and get well- paid job, as usually everybody say "my well-being is my happiness and my life". No... I want more, something important and I hope effective...My purpose is to establish national juridical system free from political dictate and oriented to democratic society's legal regulation need. One of the main ways improving this consists in right jurisprudence. My task is to effect legislation in Lithuania, taking cognizance with law discipline's defining, main ideas, constitutional work, methods... What is more, I chose "law and penitentiary work" studies to improve my theoretical and practical knowledge of law. First step to do this is dealing topical issues about society's problems- crimes and punishment. It's key why I chose this profession. As it is value system and arising different social orders, "ideologically disciplined" law exchanges implementation of liberty and human rights. In conclusion, I would like to say Seneka's words:"His lights will be valid if he try it on his own". I will try to do this...
